INTRODUCTION

Catalyst Web Services, LLC, a Delaware limited liability company (“CatalystWeb”), owns and operates www.catalystweb.com, www.catalystoffice.com and other domains needed to provide Web-based software services (the “Domains”). CatalystWeb is committed to safeguarding your privacy online as a user of our services.  We want to assure you that, except as set forth herein, CatalystWeb will not willfully disclose any specific individual information about you to any third party unless you give us your explicit permission to do so.

By using CatalystWeb services you consent to the collection and use of personal information as outlined in this Policy.  Please read this Privacy Policy (the “Policy”) for an explanation of how we will treat your personal information.  If you do not agree with this Policy, please do not use the Domains or any of our services.  If we make any material changes to the Policy, those changes will be posted on our company Website so that you are always aware of what personal information is collected, how that information is used, and under what circumstances that information may be disclosed. This Policy may change from time to time, so we suggest you check the Policy at our company Website periodically.  Your continued use of our services following the posting of changes to the Policy will acknowledge your acceptance of such changes.

1. PERSONALLY IDENTIFIABLE INFORMATION THAT IS COLLECTED

CatalystWeb collects personally identifiable information when you register for a CatalystWeb account or when you use any CatalystWeb product or service for the following purposes:

  • to deliver the products and services you or your company have ordered from CatalystWeb;
  • to maintain accounting and billing contact information and other financial records;
  • to customize the content you see;
  • to contact you regarding our services.

When you register with CatalystWeb, we ask for your name, email address, physical address, telephone numbers and, in most cases information about the credit card used to pay for products or services provided by CatalystWeb. You may also be requested to provide a username and password for certain features.  All of the personal information submitted by you will be maintained by CatalystWeb in secured servers.  Non-personally identifiable information may be collected when you visit many of our web pages or use our services.  We may also collect other personal information that will be identified on the applicable page(s) of the Domains or within the pages of our services. CatalystWeb also automatically receives and records information on our server logs from your browser including your IP address, CatalystWeb cookie information and the page you requested. CatalystWeb routinely collects information that cannot be identified to a particular individual such as time-stamps and logs events (like features used). This data is used for accounting/billing purposes as well as for the performance and optimization of our services.

3. USE OF COLLECTED PERSONAL INFORMATION

CatalystWeb may use information provided at registration or information obtained through third parties to offer better targeted products and services to you.  We also use targeting to customize and enhance your online experience with our services.  The use of information provided at registration (or edited thereafter) or obtained through third parties will not be provided to advertisers or partners, except in anonymous and aggregate form.  We sometimes use the non-personally identifiable information that we collect to improve the design and content of the Domains and the services provided on or through them and to enable us to personalize your online experience.  Additionally, a user may change or update his or her personal information at any time by visiting the registration area.  To protect your privacy and security, we will take reasonable steps to help verify your identity prior to granting access or making corrections.

CatalystWeb tracks certain general usage pattern information, including what pages people visit and how long they have been registered users, for the purposes of system administration, site tracking and reporting of aggregate usage information to our marketing and product development teams.

We may also enable you to use a “shopping cart” if you want to purchase goods or services while on the Domains, and to offer you products, programs, or services based upon purchase and usage behavior that you and/or other customers have exhibited.  If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows the user to accept or reject cookies.  If you set your browser not to accept cookies, you may not be able to take advantage of certain services offered by CatalystWeb.

We do not install any spyware or adware in connection with the Domains, or distribute any commercial message or authorize any third party to distribute any commercial message, by means of spyware or adware.  “Spyware” or “adware” is any software that has been downloaded to and/or installed on an Internet user’s computer, without the user’s actual consent, and facilitates the distribution of any commercial message to the user.  If you feel you may have spyware from another company installed on your machine, there are various anti-spyware/adware software applications available on the Internet to identify if this has occurred.

4. SHARING OF PERSONAL INFORMATION

Once again, CatalystWeb will not provide any personally identifiable information about you to advertisers or other partners without your explicit consent.  As stated above, CatalystWeb may, however, provide partners with anonymous, aggregated information about our users to illustrate trends and patterns.  All third parties with whom we share such information will have independent privacy and data collection practices and CatalystWeb has no responsibility or liability for their policies or actions.

We will never give out any information linking your real name to any CatalystWeb screen name unless you authorize us to do so, or unless we are required to do so by law.

While CatalystWeb is careful in choosing its partners, we are only responsible for content on the Domains and within our services.  All third parties associated with CatalystWeb (including, but not limited to, sponsors and other Internet sites) with whom we share information have independent privacy and data collection practices.  CatalystWeb does not control this collection of information and is neither responsible nor liable for their independent policies or actions.

We may be required to share your personal information and non-personal information (see “Cookies” section above for examples of non-personal information) pursuant to judicial or governmental subpoenas, warrants, or orders.  If we are required to do so, we will obey the law.  In addition, notwithstanding any term to the contrary in this Privacy Policy, we reserve the right to use and disclose and share your personal and non-personal information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Terms of Use of CatalystWeb services, or as otherwise required by law.

5. LINKS TO OTHER WEBSITES

The Domains may contain links to other sites.  Please note that we are not responsible for the privacy practices of third party websites.  We encourage you to be aware of this when you leave the Domains and to read the privacy policies of every website that collects personally identifiable information from you.  The Privacy Policy applies only to the Domains and to CatalystWeb services.

6. SECURITY OF PERSONAL INFORMATION

CatalystWeb has security measures in place to protect against the loss, misuse, and alteration of the information under its control.  We have put together appropriate physical electronic and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information.  Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that the personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this privacy notice.  Inadvertent disclosures may result, for example, when third parties misrepresent their identities and request access to personally identifiable information.

Only those employees needed to carry out business functions will have access to information of individual CatalystWeb users.  Employees violating these privacy policies will be subject to disciplinary action.

Whatever a user transmits or discloses online can be collected and used by others or unlawfully intercepted by third parties.  No data transmission over the Internet can be guaranteed to be 100% secure.  Although we strive to protect your personal information, we cannot warrant the security of any information you transmit to us.  In addition, we may disclose information to law enforcement or other government officials if we determine such disclosure to be appropriate, or if we are compelled to disclose it by court order or operation of law.

Any information voluntarily disclosed by users and posted on our site (on message boards and/or in chat areas) may be viewed and used by others.  If users post personal information that is accessible to the public online, the user does so at his or heher risk.  Users accept that they may receive unsolicited messages from other parties in return.

7. CHILDREN’S PRIVACY POLICY

The Web Site is not directed at individuals under thirteen years of age, and CatalystWeb does not intend to collect any personally-identifiable information from such individuals.
